Netflix has long been a thorn in the side of cable providers. It?s not hard to see why. Netflix gives consumers a cheaper option to their cable TV providers. And that?s what worries Big Cable. If there is an alternative to them, their business will suffer. Cable TV providers have done all that they can to slow down Netflix?s growth. But have they gone too far?

Netflix allows consumers to receive movies and TV shows through the mail. They also allow consumers to stream movies and TV shows through internet capable devices like computer, televisions and gaming consoles. Netflix?s monthly fee is dramatically less than that of almost all Pay TV providers. This gives consumers a less expensive entertainment option. But there are some drawbacks. Streaming content takes up internet bandwidth. That is where cable companies have found a way to fight Netflix.

Most cable TV providers are also internet service providers (ISPs). They like to bundle Pay TV and internet access and sell the package to consumers. Most providers have a cap on how much internet bandwidth a consumer can use in a given month. Once that limit is reached, a consumer usually experiences slower internet speeds. In extreme cases, the internet service provider stops a customer from using the service completely.

Netflix contends that cable companies and their ISPs are using data caps to keep consumers from using Netflix exclusively. Of course, the cable providers say that is not the case at all. They say that they are happy to provide internet access to consumers to use as they see fit to. Even those consumers that want to stream video from Netflix, Hulu or any other service. Netflix wants the U.S. government to make sure of that. They have asked a committee of the U.S. House of Representatives to make sure that Pay TV providers are not trying to keep consumers from bandwidth hogging video streaming.

Cable companies have a history of anticompetitive behavior. This wouldn?t be the first time that they have tried to keep someone from cutting into their very profitable businesses. Netflix has over 20 million subscribers and that number is expected to continue to grow. That growth could depend on Netflix?s ability to compete on a level playing field with Big Cable.

House holds Holder in contempt of Congress

The full House of Representatives voted on Thursday to hold Attorney General Eric Holder in contempt of Congress over the Justice Department's decision to withhold documents related to the failed Fast and Furious gunwalking operation.

By a vote of 255 to 67, House members voted to hold Holder in contempt, disregarding a protest walkout led by the Congressional Black Caucus (CBC).

"This is a sad day for the House of Representatives. It is an irresponsible day for the House of Representatives," House Minority Whip Steny Hoyer (Md.) said on the House floor prior to the vote. "It is a day in which the majority party asked us to take an action that has never been taken in the history of America."

Thursday's vote was the first time a sitting Cabinet officer was held in contempt. Hoyer noted that Congress has issued previous contempt citations to other officials, but that the average time between committee action and consideration was 87 days. The House Oversight and Government Reform Committee voted just last week to advance the measure to the full House.

A total of 108 Democrats out of protest on Thursday chose not to vote on the measure, with 1 lawmaker voting present.

Earlier Thursday, the House Democratic caucus voted unanimously to endorse the walkout. Just prior to the vote,?Democratic Leader Nancy Pelosi (Calif.) and Hoyer joined with the CBC, members of the Hispanic, Asian Pacific American and Progressive Caucuses as well as other lawmakers to exit the House floor in protest, filing out of the chamber in a slow-moving and crowded line.

"The Republican Leadership has articulated no legislative purpose for pursuing this course of action," the Caucus stated in a letter they previously circulated to colleagues encouraging them to join the walkout. "For these reasons we cannot and will not participate in a vote to hold the Attorney General in contempt. We adamantly oppose this partisan attack and refuse to participate in any vote that would tarnish the image of Congress or of an Attorney General who has done nothing but work tirelessly to protect the rights of the American people."

Thursday's vote marked the culmination of the Oversight Committee's push to hold the government accountable for the failings of Fast and Furious, a scheme which oversaw the sale of firearms to Mexican drug cartels, though the majority of the weapons went missing.

The committee opened an investigation into the operation to determine what the government knew and when, especially in light of a Feb. 4, 2011 letter, which the Justice Department later retracted. The letter incorrectly stated that the Bureau of Alcohol, Tobacco, Firearms and Explosives?"makes every effort to interdict weapons that have been purchased illegally and prevent their transportation to Mexico."

The Justice Department refused to hand over many of the documents subpoenaed by the committee citing internal deliberations contained in the materials. President Barack Obama backed the decision and personally exerted executive privilege over the documents last week.

Democrats argue that the Justice Department has been compliant to the extent it is able and that Oversight Committee Chairman Darrell Issa (R-Calif.) and other Republican lawmakers are simply playing politics by targeting Holder.

"The Congress should be embarrassed about the conduct of this investigation and the charade that brings us to the floor today," Democratic Rep. Chaka Fattah of Pennsylvania said on the House floor prior to the vote.

"The Attorney General can't provide these documents-- the president has protected them under... executive privilege." Fattah added that Republicans have "lost their way" and because of them, Congress is held in high contempt.

Other Democrats argue that Issa is woefully ignoring gunwalking operations conducted during President George W. Bush's administration.

But Republicans maintain that they are fulfilling their duty to hold the government accountable and offered the Justice Department many opportunities to comply.

"The Justice Department did not provide the facts and the information we requested," House Speaker John Boehner (R-Ohio) said on the House floor. In addition, Boehner said, the government "admitted to misleading Congress."

On Thursday, Republicans rejected the Democratic assertion that their fight is simply political in nature.

"I hear the stuff about witch hunt and about politics and it gets me sick," Florida Republican Rep. Rich Nugent said on the House floor. "As a former law enforcement officer, we should be more worried about what lousy policies that Attorney General Holder is covering up that caused the death of one of our own in protecting this country." Nugent invoked the name of border patrol agent Brian Terry, who was killed on Dec. 2010. Weapons related to Fast and Furious were found at his murder scene.

Holder, in a statement following the vote, accused Republicans of failing to properly respond to Terry's death.

"Today's vote is the regrettable culmination of what became a misguided-- and politically motivated-- investigation during an election year," Holder said. "By advancing it over the past year and a half, Congressman Issa and others have focused on politics over public safety. Instead of trying to correct the problems that led to a series of flawed law enforcement operations, and instead of helping us find ways to better protect the brave law enforcement officers, like Agent Brian Terry, who keep us safe ? they have led us to this unnecessary and unwarranted outcome.

The National Rifle Association, which contends the government used the operation to promote stricter gun control laws, inserted itself into Thursday's vote by warning lawmakers last week that it will use the contempt vote to rate lawmakers. The organization's decision placed added pressure on House Democrats in gun-friendly districts. Hoyer conceded that some members would change their votes accordingly.

Seventeen Democrats joined with 238 Republicans to hold the attorney general in contempt, a number Republicans say invalidates talk of political theater.

"False and partisan allegations by the White House and some congressional Democrats about the Oversight Committee's efforts were undermined by the votes of 17 Democrats," Issa said in a statement following the vote.?"These Members resisted the pressure of their own leadership and the Obama Administration to support this investigation on the House floor."

Issa, who noted that the vote could have been avoided if the Justice Department had released the pertinent documents, warned that the Republicans' fight is not yet over. "Unless President Obama relents to this bipartisan call for transparency and an end to the cover-up, our fight will move to the courts where we will prevail in getting the documents that the Justice Department and President Obama's flawed assertion of executive privilege have denied the American people," Issa said.

Following the contempt resolution Thursday-- which centered on criminal charges-- the House passed a vote of civil contempt, which could advance to federal courts.

Supreme Court Upholds Health Care Law; Obamacare Mandate Survives in 5-4 Decision


In a somewhat surprising and extremely controversial decision, the Supreme Court upheld President Obama's signature health care law Thursday morning.

The 2010 law's mandate that every American purchase health insurance or face a fine had been challenged on constitutional grounds by 26 U.S. states.

The mandate was upheld as a tax, however, by a 5-4 vote.

Chief Justice John Roberts joined the liberal wing of the Supreme Court. Tom Goldstein of SCOTUSblog says Roberts effectively "saved' the Affordable Care Act.

Obama Speech

Opponents cast the law, known pejoratively as "Obamacare," as the federal government forcing citizens to enter a market and buy a product against their will.

The government countered that the law was actually only regulating an existing market, as everyone requires health care at some point in his or her life.

Roberts and Justices Ruth Bader Ginsburg, Elena Kagan, Sonia Sotomayor and Stephen Breyer sided with the government and declared the law valid.

Ginsburg, Kagan, Sotomayor and Breyer agreed that the individual mandate should be upheld as part of Congress' power to regulate interstate commerce.

Roberts disagreed, writing that the mandate is actually a tax, despite the Obama administration's reluctance to describe it that way during the bill's passage.

In any case, however, he declared the law constitutional as such, writing:

"If an individual does not maintain health insurance, the only consequence is that he must make an additional payment to the IRS when he pays his taxes."

The U.S. Chief Justice added that this means "the mandate is not a legal command to buy insurance. Rather, it makes going without insurance just another thing the Government taxes, like buying gasoline or earning an income."

Anthony Kennedy, often the court's swing vote, dissented, saying that he and three conservative justices believe "the entire Act before us is invalid in its entirety."

Republicans have vowed to repeal the law if President Obama is defeated in 2012, though that would also require control of the U.S. House and Senate.

In any case, the Supreme Court ruling signals a major victory for Obama, who sacrificed major political capital to get his signature piece of legislation passed.

For now, the liberal dream of national health care reform - some of which is already in effect, but the bulk of which is on hold until 2014 - remains realized.

Google unveils Nexus 7 tablet, Android 4.1 and more

Google I/O, the search engine giant's annual developer conference is taking place in San Francisco, California this week. The show kicked off with a keynote event, and I was there to report live about all the things Google unveiled.

The fun?started around 9:30 a.m. PT/12:30 p.m. ET with?Google's vice president of engineering,?Vic Gundotra, stepping on stage to start things off.?He thanked everyone for being here and asked us to shut off our wireless hotspots, in order to keep everything running smoothly.

Hugo Barra, Google's?director of product management, took the stage almost right after that, to talk about some Android milestones. He explained that Android has seen over 400 million device activations. He added that over one million new Android devices are activated every day. (That's about 12 Android devices every second.)

The Google team didn't wait long to introduce folks to Jelly Bean aka Android 4.1.

Almost right away, the folks in attendance were ooh-ing and aah-ing as we saw how easily widgets can be rearranged in Jelly Bean, with everything resizing itself automatically to fit on the screen more neatly. But things got really loud in the conference center as we were shown that Jelly Bean will offer offline voice typing. (No more worrying about lousy reception affecting your handsfree typing.)

Other neat Jelly Bean features include the ability to quickly?swipe back to photos you've just taken, the option to pair devices with a tap (via NFC) to share photos and video, and?notifications?which can be expanded (so that you can view your inbox without actually leaving the notification screen, for example).

"It's like they're reinventing Siri," a fella near me muttered, to no one in particular, as Jelly Bean's Knowledge Graph integration was shown off. The feature allows your Android device to answer questions ??such as "which movies did Angelina Jolie star in?" ? or take certain commands, which involve searches, such as "show me?photos of tiny monkeys."

A tool called "Google Now" learns from your habits, your location and your calendar to offer you information you might need. For example, if you are in an area you don't usually travel through, Google Now might suggest some restaurants. If you happen to be at home and traffic conditions are bad, you might be offered alternate directions. The more you use Google Now, the smarter and more?useful?it should get.

There are more than 600,000 apps in Google Play and Google has seen over 20 billion Android app installs, we were told.

So what's new?

Well, developers will now be able to offer Smart App Updates, to devices on Gingerbread and above. This means that users will only have to download changed parts of an app, rather than re-downloading the whole thing every time there's an update.

Google Play will now also offer movies and television shows for purchase, along with magazines. Google has partnered with various studios and publishers to offer this content.

Nexus 7
Looks like the rumors were true. Google's got a shiny new tablet, called the Nexus 7.?It has a 1280 x 800 HD display, a Tegra 3 processor, a 12-core GPU,?a front-facing camera, and more. It will run Google Android 4.1.

Google's team emphasized content consumption when it comes to Nexus 7. This tablet is "made for Google Play," we were told.

The Nexus 7 will start at $199 (this price will include a handful of movies and some magazines). The tablet can be ordered now and will start shipping mid-July.

Considering that Google Play will now include?significantly?more media, that the Nexus 7 hardware is pretty darn solid sounding, and that the price is right ... I'd say that Amazon's Kindle Fire has some strong competition to deal with now.

Nexus Q
The Nexus Q is described as?the "first ever?social streaming device."?It streams your media from the cloud and allows multiple people to sync up their playlists and queue up songs by using tablets or smartphones. The device?? which somehow resembles a Death Star ? will be priced at $299 and start shipping mid-July.

If everyone relied on a Nexus Q, parties could become hilarious as folks battle for control of the tunes by tapping their respective?gadgets.

Google+
Google+ is turning one-year-old tomorrow and Google appears to be pretty proud of its social network. Over 250 million people have activated Google+ accounts and there are apparently over 150 million active users on the network. Half of those users sign into Google+ daily, we're told. Curiously enough more people are using Google+ on their mobile devices, rather than on their desktops.

So it's no surprise that Google is releasing a version of Google+ for tablets. An Android version will roll out today, and an iPad version will come soon.

There will also be some updates to Google+ itself, such as the addition of Events, Party Mode, and more. In essence, it will encourage folks to?collaborate?before, during, and after events.

Google Glass
The Google+ presentation was abruptly interrupted by Sergey Brin himself, who promised us a demo which could go wrong in a lot of ways. It turns out that a team of skydivers equipped with Google Glass was above the Moscone Center, where the Google I/O is taking place.?

We watched them, through a Google Hangout, as they jumped onto the building's roof, handed a package ? containing a pair of Google Glass ... err, glasses???off to a team of bikers. Those folks jumped over obstacles and passed the package over to some folks who scaled down the building, to the third floor, where another team of bikers waited to take the cargo over to Brin. Whew! Once all the excitement died down, we were told that the latest prototype of Google Glass weighs less than a pair of sunglasses?? and that there will be a variety of designs, not just the cyborg-like frames we initially saw.

In theory, you should be able to wear these glasses at any time, to capture a first-person view of everything you do.

Acclaimed screenwriter Nora Ephron dead at 71

LOS ANGELES (Reuters) - Oscar-nominated screenwriter Nora Ephron, known for romantic comedies "When Harry Met Sally" and "Sleepless in Seattle," as well as books and essays, has died in New York after battling leukemia. She was 71.

Ephron, who had suffered from acute myeloid leukemia, died on Tuesday evening at New York's Presbyterian/Weill Cornell Medical Center surrounded by her family, they said in a statement.

Reactions poured in from around the arts and entertainment community for the screenwriter who delighted millions with her flair for comedy, romance and the ability to tackle serious subjects with insight.

"She brought an awful lot of people a tremendous amount of joy. She will be sorely missed," her publisher, Alfred A. Knopf, said in a statement.

New York Mayor Michael Bloomberg called her death "a devastating one" for the city's arts and cultural community, and the Los Angeles-based Directors Guild of America called her "an inspiration for women filmmakers when there were few."

Writer and actress Carrie Fisher called Ephron "inspiring, intimidating, and insightful" and actor Martin Landau said she was "able to accomplish everything she set her mind to with great style."

Ephron, who often parlayed her own love life into movies like "Heartburn" and gave her acerbic take on aging in the 2010 essay collection, "I Remember Nothing: And Other Reflections," had kept her illness largely private except for close friends and family.

"At some point, your luck is going to run out ... You are very aware with friends getting sick that it can end in a second," Ephron told Reuters in a 2010 interview while promoting the book.

The elegant Ephron, known for habitually dressing in black, urged aging friends and readers to make the most of their lives.

"You should eat delicious things while you can still eat them, go to wonderful places while you still can ... and not have evenings where you say to yourself, 'What am I doing here? Why am I here? I am bored witless!'" she told Reuters.

She began her career as a journalist but transitioned into movies, leaving behind a legacy of more than a dozen films, often featuring strong female characters, that she either wrote, produced or directed. She was nominated for three Academy Awards for "Harry Met Sally," "Sleepless in Seattle" and the drama "Silkwood" in which Meryl Streep played an anti-nuclear activist.

Other romantic comedies included "You've Got Mail," starring Meg Ryan, and her last film "Julie & Julia" in 2009, which had Streep portraying the fearless celebrity cook Julia Child.

Ephron also wrote for the stage, authoring the 2002 play "Imaginary Friends" about the rivalry of authors Mary McCarthy and Lillian Hellman, and "Love, Loss and What I Wore," with her sister Delia, in 2009.

NEW YORK, WASHINGTON, HOLLYWOOD

Born May 19, 1941 in New York City and raised in Beverly Hills by screenwriter parents, Ephron worked briefly as a White House intern before going into journalism. She quickly became known as a humorist with essays on subjects ranging from food and fashion to feminism.

She started in the entertainment industry while married to her second husband, The Washington Post's famed Watergate investigative reporter Carl Bernstein.

She helped rewrite a version of the script for the movie "All The President's Men," about Bernstein and Bob Woodward's uncovering of the political scandal that led to the resignation of Richard Nixon in 1974. Although that screenplay was not used, it led to a TV movie screenwriting job for Ephron.

Her big movie break came after a messy divorce from Bernstein, which was the genesis for her 1983 novel "Heartburn" that she later adapted into the bittersweet hit film of the same name starring Jack Nicholson and Meryl Streep.

That film ushered in a string of box office successes in the late 1980s and 1990s, including "When Harry Met Sally," "Michael" with John Travolta, "Sleepless in Seattle" and "You've Got Mail," that saw Ephron gradually add producer and director to her resume and become one of Hollywood's most successful makers of romantic comedies.

Although her movies raked in tens of millions of dollars at box offices worldwide, Ephron never won the industry's highest honor, an Academy Award.

After box office flops "Hanging Up" and "Lucky Numbers" in 2000, Ephron focused on essays, writing for the stage, and blogging for the online news site The Huffington Post.

Her humorous 2006 collection "I Feel Bad About My Neck: And Other Thoughts on Being a Woman" became a bestseller on the New York Times list.

At the time of her death, Ephron had a biographical movie about singer Peggy Lee in development that was due to star Reese Witherspoon, according to the Internet movie website, IMDB.com.

Ephron was married three times and is survived by her husband of more than 20 years, writer Nicholas Pileggi, and two children with Bernstein.

The Xbox 360 pilot program's breaking out of its Microsoft Store-only confines and heading to more ubiquitous electronics retailers Best Buy and GameStop starting today. If you'll remember, Redmond intro'd this subsidized plan last month, giving prospective buyers within reach of one of its 16 participating locations the ability to purchase a 4GB version of the console for $99 with a two-year commitment. In exchange for those contract chains, gamers forking over the $15 monthly fee not only get the privilege of owning the console at a discounted, upfront cost, but also Gold level membership to Xbox Live. We'd caution you to think twice and do some hard math before you hand over the plastic, though. Tempting as that low-price barrier to entry is -- in total, a $460 value -- you might be better off grabbing this console outright at $420 or less.

Stocks end sharply lower to open the week

Concerns about the European debt crisis slammed stocks Monday, shaving at least 1 percent off the major indexes.

Just after midday the Dow Jones industrial average was down 1.2 percent, while the broader S&P 500 shed 1.7 percent and the tech-heavy Nasdaq lost 1.9 percent.

Europe's crisis, and especially worries about Spanish banks, held investors in thrall again. Spain officially asked the European Union for help to shore up its banks, which have been hit hard by rising bad loans caused by a slumping real estate market. There was very little detail about how much aid Spain would be requesting, and the uncertainty raised concerns among investors. ?

The news from Spain comes days before European Union officials are set to meet to discuss how to staunch the debt crisis in Europe that threatens to push the continent back into recession and perhaps stifle growth in the U.S., China and other parts of the world. Investors are concerned that EU officials will not be able to come up with a deal to restore confidence in the 17-nation eurozone's ability to manage its finances.

Besides Spanish banks, the EU summit Thursday and Friday was also set to look at Greece's problems and discuss the tough austerity package imposed on it as a condition for economic aid. But those planned?discussions were dealt a setback with news that both Prime Minister Antonis Samaras and incoming Finance Minister Vassilis Rapanos would miss the summit due to health problems. Rapanost resigned after being hospitalized for several days, before he could be sworn in, after complaining about dizziness and abdominal pains.

In U.S. markets, U.S. bank stocks felt the brunt of the rising anxiety?as investors fled them amid worries about their exposure to European banks.

"When the dollar rallies, almost everything else goes down," says Art Cashin, UBS, discussing growing concerns of a global slowdown, as investors take flight to safety.

3 people missing after trains collide in Oklahoma

(AP) ? Authorities are searching near the railroad tracks where two Union Pacific freight trains collided in the Oklahoma Panhandle to see if several missing crewmembers might have escaped injury.

Union Pacific spokeswoman Raquel Espinoza said the trains crashed Sunday about 10:08 a.m. Sunday near Goodwell. She said a two-person crew was aboard each train, and officials can't account for two engineers and a conductor.

The other conductor appeared to be uninjured.

Oklahoma Highway Patrol trooper Betsy Randolph says law officers were walking along either side of the tracks to see if the missing crewmembers had jump from the trains.

Randolph says a blaze that erupted after the collision has been contained, but continues to burn.

She says a firefighter was transported to a hospital for treatment of a heat-related injury.

Sea-level rise accelerates faster on US east coast

Sea level rise off the US east coast is accelerating up to four times faster than the global average. The finding confirms model predictions that the east coast will bear the brunt of the unevenly rising waters. It also suggests that a major Atlantic current may be slowing down, which could see temperatures drop in Europe.

The "hotspot" of rising sea levels extends over 1000 kilometres from Cape Hatteras in North Carolina to Boston, Massachusetts, and possibly further north into Canada. It was identified by Asbury Sallenger and colleagues at the United States Geological Survey in St Petersburg, Florida, using tide gauge data from 1950 to 2009.

News of the hotspot may come as a surprise in North Carolina, where the state Senate recently passed a bill forbidding the use of models that include accelerating sea level rise. The bill has since been rejected by the state's House of Representatives.

Up, up and up

Sea levels are rising around the world, driven by climate change. Much of the rise comes from water expanding as it heats up, but melting ice caps are also contributing. The rise is accelerating: during the 20th century levels rose at an average of 1.7 millimetres per year, but since 1993 the rate has reached 3 mm/y.

But sea levels do not rise evenly around the world. In 2009 Jianjun Yin, now at the University of Arizona in Tucson, used a climate model to predict that the US east coast would see more than its fair share of rising sea levels (Nature Geoscience, DOI: 10.1038/ngeo462).

Sallenger's data confirms that this is already happening. "This is consistent with our climate model projections," Yin says.

Conveyor stalling?

The sea level rise hotspot could be the result of a major current, the Atlantic Meridional Overturning Circulation (AMOC), slowing down. The AMOC carries warm tropical waters into the North Atlantic, keeping western Europe warmer than other northerly regions.

Back in 2005, oceanographers led by Harry Bryden of the University of Southampton, UK, claimed that it was slowing down, potentially cooling western Europe. But further studies showed that the current is highly variable, so the results were dismissed.

A slowing AMOC would cause sea levels to shoot up on the east coast of North America, so Sallenger's hotspot suggests that the current really is losing power ? especially as other factors, such as land subsidence in North America, cannot account for the accelerated sea level rise.

Bryden says that a slowdown in the AMOC should have affected sea levels as far south as Florida. "I'm not sure they've explained why it happens north of Cape Hatteras but not south," he says.

"It could be AMOC, but it may not be," says Stefan Rahmstorf of the Potsdam Institute for Climate Impact Research in Germany. Natural variability in currents and winds could also be responsible.

Though GAP?s just getting started?with standards for eggs still in development and those for dairy and lamb yet to be introduced?farmers are already helping meet the demand.
